Dear Relux user

This privacy policy will automatically take effect for all existing users on 25 May 2018 and replace the previous data protection information.

The continued use of the Relux.com platform and software applications from Relux Informatik AG are subject to the new privacy policy as of this date.

Subsequent use of the Relux.com platform and software applications by Relux Informatik AG without the user's consent is not possible afterwards.

  1. 1.GENERAL INFORMATION AND PURPOSE OF DATA PROCESSING

When using the Relux.com platform and software applications from Relux Informatik AG, we collect anonymous and personal data.

We need this information to properly fulfill the contract between you and us and to comply with our legal obligations. Without this information, we may not be able to provide you with all the services you require.

Users are almost exclusively legal entities related to the companies or legal entities that obtain services from Relux. (GDPR Art. 14).

Paid-for products of Relux Informatik AG are sold and delivered exclusively to legal persons.

The free products can also be downloaded from the relux.com platform and used by private individuals. This privacy policy therefore also applies to these private individuals.

  1. 2. HOW WE USE THE INFORMATION WE COLLECT?

We use, store and process information, including personal data, about you in order to provide the Relux.com platform and software applications from Relux Informatik AG, to be able to process registrations for webinars and training courses as well as orders, to analyze, improve and further develop, and to create and maintain a trustworthy and secure environment and to comply with our legal obligations.

  • To be allowed to use the Relux.com platform and software applications from Relux Informatik AG
  • In order to further develop the Relux.com platform and software applications from Relux Informatik AG, improve and let unused functions be phased out.
  • To provide our customer service for administration and support.
  • To send you service or support notifications such as updates, security alerts, and account notifications.
  • Data and rights of your invited contacts in your account will not be used any further and are exclusively the responsibility of the account owner.
    1. 2.2 Creating and maintaining a trusted and secure environment
  • To detect and prevent fraud, spam, abuse, security incidents and other malicious activities.
  • To carry out safety investigations and risk assessments.
  • To comply with our legal obligations.
  • To settle any disputes with our members and to enforce our agreements with third parties.
  • To ensure compliance with our sales and delivery terms and license terms or other guidelines.
    1. 2.3 Provide, personalize, measure and improve our advertising and marketing activities
  • To send out promotions, marketing information, advertising and other information that may be of interest to you based on your preferences.
  • To personalize, measure and improve our advertising.
  • For the implementation of recommendation programs, loyalty bonuses, surveys, competitions, prize draws or other sales-promoting activities or events carried out by Relux Informatik AG.

  • To enable you to access and use the payment services.
  • To detect and prevent fraud, abuse, security incidents and other malicious activities.
  • To carry out safety analyses and risk assessments.
  • To carry out checks on databases and other sources of information.
  • Compliance with legal obligations (e.g. money laundering regulations).
  • To ensure that the terms of sale and delivery are met.
  1. 3. DATA WE COLLECT

The data we collect is divided into two categories.

    1. 3.1 Data you transmit to us
  • Account information. When you set up a Relux account, we mandatorily require information including first name and surname, your e-mail address (will be verified), country, and the industry in which you operate.
    For the hotline and forum a personal photo, title, business and mobile phone number, time zone, Twitter account and preferred language can be stored additionally and optionally for communication with Relux Informatik AG.
  • Communication. To communicate with other account owners who you invite to share your saved favorites and your own products.
  • Payment details. For the acquisition of licenses, for webinars or training courses in the training centres of Relux Informatik AG or its official distributors in various countries of Relux Informatik AG. We may ask you to provide your billing and delivery address as well as bank account or credit card information in order to facilitate the processing of sales-relevant processes.
  • Crash data. This data can be sent to Relux Support support@relux.com in the case of a customer support request in order to make it easier to find possible bugs. Such a file is stored manually by the user as an attachment to the communication.
  • Support. For inquiries to Relux Informatik AG support, please provide us with information about, the type of inquiry, the product name to which your inquiry refers and, if necessary, add an attachment - usually a project file - to which your inquiry refers.
  • Forum. The forum is a publicly visible platform in which account holders can exchange information, create new topics and communicate with each other.
    1. 3.2 Data that we collect automatically
  • Location data. To recognize the location, the IP address of the device is used to determine the exact or approximate location and to store the account data.
  • Usage data. We collect information about your interactions with the Relux.com platform, such as the pages you visit or other content, your search queries and product downloads.
  • Which manufacturer products are downloaded and used in planning.
  • Anonymized log data and device information. When using the Relux.com platform and software applications from Relux Informatik AG, we automatically collect anonymous log data and device information, what you use (including any clicked links to third-party applications), access data and times, information on hardware and software used, device information, data on device events, unique identifiers, cookie data.

License keys. Paid services and licenses are monitored by the external partner WIBU Systems. Only customer and order numbers of legal entities are stored. Authentication of the person or personal data of a legal entity is only possible manually by employees of Relux Informatik AG in the internal sales systems via the order number.

  1. 4. DISCLOSURE

Relux is entitled to pass on the above-mentioned account, usage and anonymous log data of users who work with the Relux.com platform and software applications from Relux Informatik AG.

    1. 4.1 Disclosure to
  • Contractual partners. Contractually or under company law bound companies which support Relux in parts of its business processes or offer common contents, products and services. These companies only use the data if their services are used by members or users and may not be disclosed to third parties. For more information on these and other companies and their role, see section 7.
  • Relux Members. Members of Relux. This is a limited, disclosed circle of members on relux.com. These members may only use the data for their own purposes and may not be passed on to third parties or used for non-business purposes without the consent of the customer/member.
  • Legal obligations. Relux Informatik AG may pass on your data, including personal information, to courts, criminal prosecution authorities and other state authorities as well as to authorized third parties, if and to the extent this is legally required or permitted or the passing on is required from a factual point of view. This applies in particular to

    • In Response to Legal Claims against Relux Informatik AG
    • In response to requests for information on data protection/verified requests in accordance with the data protection form available for this purpose
    • For the fulfilment and application of our license terms, sales and delivery conditions, general terms and conditions for members, general terms and conditions for ReluxNet members as well as individual agreements.
  • Company mergers. If Relux Informatik AG carries out or is involved in a merger, takeover, restructuring, sale of assets, bankruptcy or insolvency proceedings, we can sell, transfer or pass on our assets including your data - in connection with such a transaction or in consideration of such a transaction (e.g. duty of care). In this case, we will notify you before personal information is transferred and covered by another privacy policy.
  • Aggregated data. Relux Informatik AG may also pass on aggregated data (information about our users that we combine so that they no longer identify or refer to individual users) and other anonymous data for compliance with legal regulations, for purposes of industry and market analysis, demographic profiling, marketing and advertising and for other business purposes.
    1. 4.2 Reasons for disclosure
  • Contractual partner. Companies that are contractually or under company law affiliated with Relux Informatik AG in order to be able to provide their services. (e.g. online helpdesk, more see section 7)
  • Relux Members Relux members finance the Relux.com platform and software applications from Relux Informatik AG with an above-average percentage of their annual fees and would like to receive anonymized figures on the number of installations of desktop applications and the use of the platform.
    Furthermore, Relux members want to know who (not anonymized data: country, company name, title, first and last name, email address) downloads their product data from relux.com and use them for their own purposes.
  • Legal obligations. To fulfill our legal rights and obligations.
  • Business mergers. Entrepreneurial freedom or reduction, prevention of damage to potential contractual partners.
  • Aggregated data. Publication of figures about the number of users, program installations, etc. based on anonymized data. Such data represents an important basis for decision-making for business relations with Relux members.
  1. 5. ACCOUNT SETTINGS THAT ARE RELEVANT TO PRIVACY PROTECTION

Owners of a relux.com account have the possibility to let Relux Informatik AG know if they would like to receive newsletters or not.

Not accepting the data privacy policy will result in limited functionality. As a result neither product data of Relux members can be downloaded from the platform relux.com nor can desktop versions of Relux Informatik AG be used.

  1. 6. DELETING AN ACCOUNT

Owners of a relux.com account have the possibility to delete their account with its content at any time and by themselves. If your account is deleted, all support requests and forum posts on our support platform (Freshdesk) are automatically deleted.

This requires a successful login and a subsequent invoking and confirmation of the delete function.

Relux Informatik AG keeps a record of successful deletion for security reasons. A later recovery of this data will no longer be possible.

  1. 7. PARTNERS & INTEGRATIONS

Relux Informatik AG uses services/applications of partner companies, which are listed in this chapter, to fulfil our services. Relux Informatik AG is neither the owner of these companies, nor is it in a position to control them. If you interact with them, you can transmit data directly to the external partner, Relux Informatik AG or both. These partners have their own rules on the collection, use and dissemination of data, but must comply with the GDPR data protection guidelines. This applies to the extent that Relux Informatik AG obtains or delivers personal data via these tools.

Support & Forum

Relux Informatik AG uses products of Freshworks, Alte Jakobstraße 85/86, Hof 3, Haus 6, Berlin, Germany 10179 for support and forum functions.

Relux Informatik AG uses products of WIBU Systems AG, Rüppurrer Straße 52-54 76137 Karlsruhe, Germany for paid services and licenses. The privacy policy of WIBU Systems AG can be found here.

Social media platforms

Relux Informatik AG uses social media platforms such as Facebook, LinkedIn, YouTube etc. for communication with users. The personal data of these followers are located exclusively in these social media platforms and are neither actively used, nor controlled or monitored by Relux Informatik AG. Therefore, questions regarding the processing of your personal data by the provider of their social media platforms should be addressed to these providers.

Please note that if you do not want to receive any more news from Relux Informatik AG on these social media platforms, then you have to unsubscribe as a follower in the respective topics or groups.

GIScience

Certain areas of the relux.com platform use the services of the University of Heidelberg for map functions. Relux Informatik AG does not store any user-specific data when using this service. The data protection regulations of the University of Heidelberg can be found here.

E-Mail Client

Payment services

As of the date of publication of this Privacy Policy, there are no commercially binding business relationships with online payment services.

 Google Analytics & Google AdWords

Visits, length of stay, downloads etc. of the relux.com platform are monitored with Google Analytics and stored anonymously. There is no connection between an account on relux.com and this data.

Google AdWords campaigns help to find services of Relux Informatik AG. Corresponding evaluations are anonymized. There is no connection between an account on relux.com and this data.

  1. 8. Cookies and related technologies

Web servers may collect information about your use of the Web site. This is done with the help of cookies.

Cookies are pieces of information that your web browser stores on your computer's hard drive. When you return to the relevant website, the server automatically recognizes the cookie and provides information about your last visit. Most browsers automatically accept cookies. You can disallow or block the use of cookies in your browser.

In the section for users of the relux.com platform, cookies are used to ensure that the browser recognizes users by storing the login data in a cookie. By accessing the relux.com platform from local applications of Relux Informatik AG, it is additionally ensured that only readable product data is offered for the respective applications (e.g. rfa product data for users of Revit from Autodesk).

  1. 9. YOUR RIGHTS

In the event of any discrepancies, you can send all the relevant information described in this section to our data protection department in writing using our "data protection enquiry form". Please note that we will only process completely filled-out forms and may ask you to confirm your identity before taking any further action.

We reserve the right to invoice or refuse requests according to internal and external accrued expenses to the applicants according to GPDR Chapter 3, Section 1, Art. 12, Sections 5 and 6.

    1. 9.1 Duty to provide information

With reference to this privacy policy of Relux Informatik AG, the user has all necessary information (according to GDPR Chapter 3, Section 2, Art. 13, No. 1).

    1. 9.2 Right to information

Upon request, you will receive clear information on the processing of your personal data in accordance with GDPR Chapter 3 Section 2 Article 15. This information is free of charge subject to GDPR KAp. 3, Section 1, Article 12, Section 5.

    1. 9.3 Right to correction and deletion

The user has the right to correction and deletion (see also chapter 6 of the data privacy policy of Relux Informatik AG) of personal data (according to GDPR chapter 3, section 2, art. 16 & art. 17).

    1. 9.4 Right to limitation of processing

The user has the right to request the responsible person to restrict the processing (according to GDPR Chapter 3, Section 3, Art. 18) or to do so himself/herself in the account settings. See chapter 5 of the privacy policy of Relux Informatik AG.

    1. 9.5 Right of notification in case of correction or deletion of personal data

The user has the right to be informed by the person responsible in case of correction or deletion of personal data. The deletion of personal data can be carried out by the user in the relux.com account. A confirmation of deletion (according to GDPR chapter 3, section 3, art. 19) will be sent in an automated message correspondingly.

    1. 9.6 Right to data transferability

The user has the right to all personal data on relux.com of Relux Informatik AG according to (according to GDPR chapter 3, section 3, art. 20), in a machine-readable format. On relux.com these are "own products" in your own account as well as personal data (country, industry, company name, company address, billing address, title, first name, surname, photo, email address, telephone number, mobile number).
